We’ll no longer tolerate strikes that don’t follow due process – FG warns

The Federal government says it will no longer tolerate industrial actions that do not follow due process “particularly during the transition period of the current administration”.

The Minister of Labour and Employment, Chris Ngige, issued the warning after receiving an ‘award of excellence conferred on him by the Nigerian Association of Resident Doctors (NARD) at the 42nd annual general meeting/scientific conference of the association.

A statement released by his media aide, Olajide Oshundun, quotes the Minister as saying;

“The federal government will no longer tolerate a strike that does not pass through due process.

Any group that embarks on strike will be visited with section 43 of the Trade Dispute Act (TDA), Laws of the Federation of Nigeria (LFN) 2004.

It says that when a worker goes on strike, especially those on essential services, the employer can also refuse to pay compensation or wages which accompanies work done.

The due process of a strike is that social dialogue negotiation with employers should be explored first.In the event of failure, the federal ministry of labour and employment office in the affected state or FCT should be notified and, finally, a trade dispute notice (TDN) served.”

He advised all aggrieved unions to emulate the doctors and commence proactive discussions with the federal government rather than resort to strike whenever issues arose.

Unstable power supply in the country is sometimes caused by deliberate vandalism – Minister

Goddy Agba, minister of state for power, has said that the unstable power supply recorded in the country is sometimes caused by deliberate vandalism and not necessarily a grid collapse.

Agba made the claim during the investigative hearing of the house of representatives committee on power in Abuja on Thursday October 20.

The Minister also noted that some of the blackouts came from a trade union matter in the power supply structure.

He said; “In September, there was a blackout nationwide for a short while and some youths were seen on social media switching off the system.

“That was not a system collapse. That was deliberate vandalism. In fact, it was sabotage.

“How can young men go and switch off the light, thereby putting the nation in blackout just because of some grudges.”

Sule Abdul’aziz, managing director, Transmission Company of Nigeria (TCN) who also spoke at the hearing, said total system disturbances declined between 2017 and 2021.

He added that there’s been significant and sustained improvement in grid stability with every passing year.

Joy Ogaji, Executive Secretary of the Association of Power Generation Companies, on her own part blamed the unstable power supply in the country on obsolete infrastructure and excessive volatile load.

Ogaji revealed that some of the equipments used in the Nigerian power sector are over 25 years old.

She added;

“The instability and unavailability of most transmission lines are other problems.” Ogaji further revealed that the improvement recorded in power supply is because generation companies’ machines are now being used to manage the grid, contrary to the grid code provision.

She concluded by revealing that 97 percent of the time, the grid was on high frequencies.

This will be done in the national interest.”

Adegoroye said;

“By the grace of God, I’ve been a member of the Federal Executive Council, the highest decision-making body in this country today, and I’ve been there now since July.

‘Nnamdi Kanu is a flight risk’- FG tells Supreme Court

The Federal Government has claimed that Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB) is a flight risk.

The FG made this known in legal documents as it filed seven grounds of appeal against the Court of Appeal judgment which discharged Kanu on October 13.

It asked the Supreme Court to set aside the judgment and restore the charge against the respondent to be tried at the trial court.On Thursday, October 20, the federal government, in a motion on notice in support of the appeal, says it seeks a stay of execution of the judgment of the court presided over by Justice Jummai Sankey, pending the hearing and final determination of its appeal, noting that the IPOB leader posed a flight risk.

The notice of appeal dated October 18 was signed by the Director, Public Prosecution of the Federation, Mohammed Abubakar, Assistant Chief State Counsel, D. Kaswe and A. Aluko and Senior State Counsel, G. Nweze, Department of Public Prosecution, Federal Ministry of Justice.

The appellant said that the appellate court wrongly interpreted the law when it held that the trial court had no jurisdiction to try Kanu because of “the extraordinary rendition of the respondent.”

It stated,

“There was no evidence led by the respondent before the court of the first instance and indeed before the court below to show how he was allegedly abducted and rendered to Nigeria as required by Section 139 of the Evidence Act, 2011 since he alleged that he was abducted without following due process of law.”

The appellant said that the appellate court wrongly interpreted the law when it held that the trial court had no jurisdiction to try Kanu because of “the extraordinary rendition of the respondent.”It stated,

“There was no evidence led by the respondent before the court of the first instance and indeed before the court below to show how he was allegedly abducted and rendered to Nigeria as required by Section 139 of the Evidence Act, 2011 since he alleged that he was abducted without following due process of law.”

The appellant also contended that the court erred when it held that the executive arm must not be allowed to benefit from the abduction of the respondent “when in fact and by its judgment, the respondent was allowed to benefit from his illegality of disobeying the orders of the court when he jumped bail and was rewarded with a discharge from the charges pending against him at the trial court thereby occasioning a miscarriage of justice against the state and the victims of the crimes perpetrated by the respondent.”

The government claimed that the appeal court was wrong by saying that how Kanu was brought back to the country can indeed weaken the criminal charges of treason, treasonable felony and terrorism brought against him.

The FG added that the appeal court made that decision without taking into account the fact that the nature of the “entry’’ of the respondent is not relevant in the determination of the charges against him.

The appellant further stated that the appeal court justices failed to be bound by established judicial precedent on the mode of “entry” of a defendant charged with the commission of an offence established by the Supreme Court.

“The court below overlooked the submissions of the appellant with regards to the ACJA, 2015 which takes its taproot from the grundnorm Section 36 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) to the effect that it is the Administration of Criminal Justice Act, 2015 that governs the trial of every Nigerian charged with the commission of a crime, this failure occasioned the miscarriage of justice,’’ the appeal notice read.

The FG further argued that the court below erred in law when it discharged the respondent of the offences mentioned in counts 1, 2, 3, 4, 5, 8 and 15 bordering on terrorism offences contained in the amended charge dated January 14, 2022, and retained by the trial court for want of jurisdiction.

“If the learned Justices of the Court of Appeal had taken into consideration the act of illegality of the respondent in jumping bail and the corresponding duty of the appellant to ensure his presence in court, the decision of the court would have been different,’’ the appeal read.

NLC kicks against registration of new academic unions, tells Ngige that it would destroy cordial industrial relations

The Nigeria Labour Congress (NLC) has kicked against the registration of two new academic unions by the federal government.

Recall that Minister of Labour and Employment, Chris Ngige, presented letters of recognition to two new unions; Congress for Nigerian University Academics (CONUA) and the Nigeria Association of Medical and Dental Academics (NAMDA), amid the strike by the Academic Staff Union of Universities (ASUU).

NLC President, Ayuba Wabba who has now reacted to this, called for the withdrawal of the recognition on the grounds that the registration of the unions contravened the laws guiding trade unions.

Wabba also said that the recognition is designed to “destroy” cordial relations. The NLC President further averred that asides Ngige previously revealing that the new unions applied for registration in 2018, which according to him is a clear contradiction of the minister’s claim of regrouping as justification for awarding certificates to them, article 3(2) of the International Labour Organisation (ILO) convention 87 on freedom of association and protection of the right to organise also makes it clear that public authorities should not interfere in the activities of trade unions.

The statement read;

“The question on the mind of every rational Nigerian is what is your motive for registering CONUA and MAMDA? Is it re-grouping of trade unions or is it a response to the application made by CONUA and MAMDA since 2018 to be registered unions?

“Unfortunately, you have accused us of interference when the opposite is the reality.

“Your biased attempt to ‘re-group’ an existing trade union or actually individuals (something our labour laws never contemplated) in utter disregard to tripartism which is a core pillar of ILO is an attempt to interfere with, infiltrate and balkanize an existing trade union — at best to score on vendetta and at worst to destroy cordial industrial relations in Nigeria.

“We are also concerned that your ’patriotic‘ intervention to rescue the so-called expelled and insufficiently represented academic staff in our universities came after you publicly admitted your utmost frustration with your inability to resolve the ASUU strike.

“Overall, Honourable Minister, we still want to believe that you were not properly advised on this matter.

“As the Chief Labour Law Officer of the Federal Republic of Nigeria, we believe that you will take advantage of our presentation of the true position of the law to redress this grave injustice done to our labour jurisprudence by the ‘awarding’ of trade union certificates to CONUA and NAMDA.”

Alleged money laundering: Ex-Lagos Attorney General, Supo Shasore, arraigned in court, granted N50m bail

The Economic and Financial Crimes Commission (EFCC) has arraigned a former Lagos State Attorney-General and Commissioner of Justice, Olasupo Shasore, over money laundering allegations, totaling more than 200,000 dollars.

When the charges were read to him, the Senior Advocate of Nigeria pleaded not guilty to the four count-charge at the Federal High Court, Ikoyi, Lagos before Justice Chukwujekwu Aneke.

The EFCC legal team is led by Bala Sanga, a senior advocate of Nigeria, while four Senior Advocates of Nigeria are appearing for Mr. Shasore.

They are Yemi Candide-Johnson (SAN), Dr. Muiz Banire (SAN), Segun Ajibola (SAN) and Chijioke Okoli (SAN).

After the arraignment, the defendant through his counsel then applied for bail on liberal terms or on self-recognizance, arguing that Mr. Shasore (SAN) isn’t a flight risk who will be present for his trial at all times and that the alleged offences are bailable.

The EFCC, on its part, didn’t object to the bail application. The court granted him bail in the sum of N50 million and is to provide a surety in like sum.

Lagos Police PRO, SP Benjamin Hundeyin, speaks on why teargas and water canons were fired at Nigerians marking 2nd anniversary of EndSARS Lekki shooting

The spokesperson of the Lagos state police command, SP Benjamin Hundeyin, has denied reports that gunshots were fired at Nigerians marking 2nd anniversary of the EndSARS Lekki shooting this morning.

Some Nigerians including rapper Falz and actor Mr. Macaroni, staged a memorial walk along the tollgate this morning to mark the day.

Pandemonium broke when teargas canisters were fired as well as water canons by the police.

Reacting to the outcry by Nigerians, Hundeyin said the teargas canisters were fired because some of the Nigerians staging the memorial walk decided to be lawless and started mounting the toll complex.

He said this was an action that threatened the existing law and order in the area and so teargas canisters were fired to disperse them.
