ICC prosecutor seeks investigation into abduction of Nigerian school children

The prosecutor of the International Criminal Court (ICC) is seeking authorisation from the Pre-Trial Chamber of the court to open an investigation into cases of abduction of schoolchildren in several parts of Northern Nigeria, closure of schools in the region, and the persistent failure of the government both at the federal and state levels to end the abductions.

The decision comes after a petition was sent to the court by the Socio-Economic Rights and Accountability Project (SERAP).

The development was disclosed in a statement on Sunday by SERAP’s Deputy Director, Kolawole Oluwadare.

SERAP had in the petition dated September 4, 2021, urged the ICC prosecutor, Mr Karim A. A. Khan, to “push for those suspected to be responsible and complicit in the commission of these serious crimes, to be invited and tried by the ICC.”

In the petition, SERAP argued that the severe and lifelong harms that result from depriving children of the right to education satisfy the gravity of harm threshold under the Rome Statute.

SERAP’s petition read: “Senior government officials know well or ought to know that their failure to prevent these crimes will violate the children’s human rights and dignity.

“The absence of any tangible and relevant investigation or prosecution in Nigeria suggests that the authorities are unwilling or unable to carry out genuine investigation or prosecution of those suspected to be responsible for and complicit in the abduction of students.

“The consequences of persistent abductions of students, closure of schools, and the failure to provide safe and enabling learning environments despite federal and state authorities yearly budgeting some N241.2 billion of public funds as “security votes”, are similar to those of the offences in article 7(1).

More than 10,000 schools have been reportedly closed in at least seven northern states over the fear of attack and abduction of pupils and members of staff. The states are Sokoto, Zamfara, Kaduna, Kano, Katsina, Niger and Yobe.”

The petition continued, “Among the string of abductions in Zamfara was the abduction of over 200 schoolgirls in the town of Jangebe in February. The latest abduction comes after widespread reports of abduction of students and closure of schools in many states of Nigeria, including in north-central Niger State where some 91 schoolchildren were abducted.

An estimated 1.3 million Nigerian children have been affected by frequent raids on schools by suspected terrorists. Some 13 million Nigerian children are out of school nationwide. According to the United Nations Children’s Fund (UNICEF), more than 1,000 students have been abducted from schools in northern Nigeria since December 2020.

“Families and parents have reportedly resulted to paying the terrorists thousands of dollars as ransom to secure the release of their children. An estimated $18.34 million was reportedly paid in ransoms between June 2011 and the end of March 2020.

Nigerian authorities have also failed and/or neglected to satisfactorily address the abduction of 276 schoolgirls from Chibok in 2014, which prompted the #BringBackOurGirls campaign. According to reports, more than 100 of those girls are still missing.”

Responding to the petition, Khan in a letter with reference number OTP-CR-363/21, and dated 22 October 2021 confirmed to SERAP that “the criteria for opening an investigation into a string of abductions and closure of schools in some parts of Nigeria have been met.”

The letter signed on the prosecutor’s behalf by the Head of the Information and Evidence Unit, Mark P. Dillon, read in part: “On behalf of the Prosecutor, I thank you for your communication received on 13/09/2021, as well as any subsequent related information.

The preliminary examination of the petition is considered complete. Under Article 53 of the Rome Statute, the next step in the judicial process is for the Prosecutor’s Office to prepare and submit a request to the Pre-Trial Chamber for authorisation to open an investigation on Nigeria.

“Once submitted, the request will be made publicly available on the Court’s website: www.icccpi.int. Your communication will be forwarded to the relevant team to be analysed, together with other related communications and other available information, in the context of any future investigations. We thank you for your interest in the ICC.”

Remarking to the development, Oluwadare said the ICC prosecutor has taken a significant step toward ensuring that those suspected to be responsible for the grave crimes against Nigerian schoolchildren are exposed, and held to account.

The victims of these crimes deserve justice. Impartial justice and reparation will deal a decisive blow to the impunity of perpetrators, and improve access of Nigerian children to education. SERAP will work closely with the ICC to achieve these important objectives,” he said.

IGP suspends Kyari as four-man special investigation panel begins probe

The Inspector-General of Police (IGP), Usman Alkali Baba, has recommended the immediate suspension of DCP Abba Kyari, the Head of the Police Intelligence Response Team (IRT) from the Service of the Nigeria Police Force, pending the outcome of an ongoing internal investigations touching on him.

Kyari had been in the news after a US court directed the Federal Bureau of Investigation to arrest and detain him over links to an internet fraudster, Abbas Akande, also known as Hushpuppi and his role in an alleged internet fraud of about $1.1 million.

The Force Public Relations Officer, CP Frank Mba, disclosed Kyari’s suspension in a statement on Sunday, saying that the IGP, in his letter to the Police Service Commission, on Saturday 31st July, noted that his recommendation for Kyari’s suspension is in line with the internal disciplinary processes of the Force.

It would be recalled that Ramon Abbas aka Hushpuppi, a Nigerian alleged internet fraudster, who is currently facing trial in the United States for internet crimes had indicted Kyari.

Hushpuppi who was arrested in Dubai and extradited to the United States had allegedly told a US court that he bribed Kyari to arrest and jail an associate of his, Chibuzo Vincent, after the $1.1 million deal went wrong.

However, in a statement on his Facebook page, Kyari admitted that Hushpuppi actually sent N300,000 to him, saying it was not a bribe but money meant for some clothes he (Hushpuppi) wanted to buy from his (Kyari’s) designer.

Officials of the Federal Bureau of Investigation (FBI) had also reportedly met with the Inspector General of Police, Usman Baba to discuss Kyari’s extradition to the United States, after the US District Court for the Central District of California issued a warrant of arrest for him and ordered the FBI to take action to extradite him to the US.

According to Mba, the IGP said the suspension would create an enabling environment for the NPF Special Investigation Panel (SIP) to carry out its investigations into the weighty allegations against Kyari without interference.

He explained that the suspension is without prejudice to the constitutional presumption of innocence in favour of the officer.

The SIP, comprising four Senior Police Officers, is headed by the Deputy Inspector General of Police, DIG Joseph Egbunike, who is in charge of the Force Criminal Investigations Department (FCID).

“The SIP, inter alia, is to undertake a detailed review of all the allegations against Kyari by the US Government as contained in relevant documents that have been availed the NPF by the Federal Bureau of Investigation (FBI).

“The SIP is also to obtain a detailed representation of Kyari to all the allegations levelled against him, conduct further investigations as it deems fit, and submit recommendations to guide further actions by the Force Leadership on the matter.

Meanwhile, the IGP has reaffirmed the commitment of the Force to the Rule of Law and assured the public of the sanctity of the probe as well as the absolute respect for the rights and privileges of the officer throughout the period of the investigations”.

Tinubu is under investigation – EFCC Chairman

Chairman of the Economic and Financial Crimes Commission (EFCC), Abdulrasheed Bawa, says national leader of the All Progressives Congress (APC), Bola Ahmed Tinubu, is under investigation.

EFCC boss stated this in an exclusive interview published by Thisday on Sunday, while answering a question on why he is yet to arrest the former Lagos state governor.

Bawa noted that investigation does not end in a day.

He said: “You asked me a question earlier about arresting people before investigation and now you are saying why didn’t we arrest Tinubu? Why didn’t you just say ‘arrest him?’

Investigation is ongoing. When you are investigating matters like this, they don’t end in a day. Thousands of investigations are going on, on a daily basis.

“You understand? You know you are from the media. After you will say we are doing media trial.”

Bawa was said to have requested for Tinubu’s assets declaration form when he was the head of Lagos Zonal Office.

Lekki Toll Gate shooting: Sanwo-Olu gives details on investigation

The Governor of Lagos State, Babajide Sanwo-Olu, has said the terms of reference of the Judicial Panel set up to investigate police brutality and rights violation has been expanded.

He disclosed this on Friday, while briefing reporters at the Lagos House in Marina.

It comes three days after some #EndSARS protesters were killed in a shooting at the Lekki toll gate.

“So what we have done is that we have consulted and we are now expanding the terms of reference of the panel that we have set up because it is exactly the same kind of composition,” Governor Sanwo-Olu said.

“That same panel headed by retired Justice Doris Okuwobi will be investigating all of the issues that happened at the Toll Plaza on Tuesday night. Their terms of reference have been expanded and for emphasis, the sitting will start on Monday at the Lagos Court of Arbitration International Centre in Lekki.”

The governor also asked residents to provide the panel with useful information that will help in the effective probe against SARS operatives.

He said: “They will be receiving petitions from Monday. If you need to send the petition via email, their address is judicialpanelonSARS@lagos.gov.ng.

“We will expect everyone that has a case or petition or something to pass unto this panel. They have been empowered extensively to determine how they run and conduct themselves at the panel.”

During the swearing-in of the panel members on October 19, Governor Sanwo-Olu noted the panel will sit for six months.

Prophetess In Police Net For Fraud

The Ogun State Command of Nigeria Police has arrested a Prophetess of Celestial Church of Christ, Oluwakemi Sotonode, also known as Marvelous Parish for allegedly obtaining money running to millions of naira from many people under false pretense.

In a statement released and signed by the command spokesperson, Abimbola Oyeyemi said the self-styled prophet of CCC Marvelous model parish, Obada-Oko has been on the wanted list of the Command for quite some-time now when a petition was received by the Command from one Idris Ilyas on the 11th of November 2019 in which he reported that the suspect contacted him to supply Kaolin stone to a company, and when he did, the suspect went to the company, received the sum of #1.2million on his behalf and converted it to her own use. “Also, on the 30th of September 2020, the same prophetess collected the sum of #200,000 from one Olabangboye Olalekan under the pretense that she will sell a plot of land for him at Obada-Oko area of the State but disappeared after collecting the money

“Likewise in April this year, the same suspect contacted one Kehinde Ojekunle ‘F’ to supply Kaolin worth of N300,000 to a company and she went behind her, collected the money on her behalf and converted it to her own use’.

“In March 2020, the same suspect obtained the sum of N670,000 from one Gbolagade Damilola under the pretense of supplying her 40 bags of rice but she ran away since then”.

“On the strength of these complaints, the Commissioner of Police, CP Edward Ajogun directed the officer in charge of the Public Complaint Bureau to ensure the arrest of the so-called prophet. “The team embarked on an intelligence-based investigation which yielded positive results on Tuesday, 6th of October 2020 when she was apprehended in her hideout. “On interrogation, she admitted collecting all the money stated above but she has not been able to give any reasonable account of it all.

Oyeyemi said the Commissioner of Police, CP Edward Ajogun has ordered a thorough investigation of the suspect and that she should prosecuted accordingly
