Attempts to secure lawyer, Inihebe Effiong’s release through sustained engagement has been unsuccessful – NBA President, Olumide Akpata

The President of the Nigerian Bar Association NBA, Olumide Akpata, has said that various attempts employed by the association towards the release of a popular lawyer, Inihebe Effiong, have been unsuccessful.

On July 27, Effiong raised an alarm on social media after an Akwa Ibom Chief Judge, Justice Ekaette Obot, sent him to jail for one month following his alleged contemptuous conduct while in court. He alleged that he was sentenced to one month in prison after he asked the Chief Judge to remove the armed policemen in the courtroom. He shared photos of himself in the prison van after he was escorted out of the court premises. Read here.

In an update given this morning on social media, Akpata said efforts to get the matter resolved and get Effiong released from prison have been unsuccessful. According to him, the Chief Judge indicates that she is ”unwilling or unable to further entertain the matter.’ Akpata says findings by the NBA show the court did not follow due process in the committal proceedings.

He said Effiong was not given a ‘fair hearing in court and an opportunity to recant or purge himself.’ He added that the NBA will now explore the option of appealing the decision of the judge.

Read his statement below…

”Last week, I provided an update on the efforts being made by the Nigerian Bar Association (NBA) towards securing the release of our colleague, Mr. Inibehe Effiong, who was remanded in custody on the order of the Chief Judge of Akwa Ibom State on account of alleged contemptuous conduct in Her Lordship’s court.

Unfortunately, attempts to secure Mr. Effiong’s release through sustained engagements at different levels have been unsuccessful with the Chief Judge indicating that she was unwilling or unable to further entertain the matter. In the circumstance, the NBA is left with no choice but to work on an appeal against the decision of Her Lordship, and I have instructed the NBA team to work with Mr. Effiong on an immediate appeal.

This is not the outcome that we had expected because there is a high chance that Mr. Effiong would serve out his one-month custodial term before the end of the appeal.

Regardless of the conduct of Mr. Effiong in the courtroom on the date of the proceedings that led to his committal, one thing that has come out from the various accounts that the NBA has so far received is that Hon. Justice Ekaette Obot did not follow due process in the committal proceedings.

Mr. Effiong was not put in the dock, told what his wrong or contempt was, given fair hearing or even an opportunity to recant or purge himself (a courtesy that the Bench should, at the minimum, extend to counsel where counsel’s conduct is said to be contemptuous).

This on its face not only runs afoul of known practice and procedure in such cases but is also unconstitutional. In view of the foregoing and depending on the outcome of our ongoing investigations, the NBA may be forced to take this matter up with the National Judicial Council.”

Igboho will be released soon – Lawyer

Yoruba freedom fighter, Sunday Adeyemo aka Sunday Igboho, will soon be released from detention in Benin Republic, according to human rights lawyer, Pelumi Olajengbesi.

He made this known in a Facebook post while scolding Yoruba leaders for allegedly being selfish.

Igboho was arrested at Cotonou airport on his way to Germany alongside his wife in July 2021.

Olajengbesi, who secured the release of 12 Igboho’s aides arrested by operatives of the Department of State Service, noted that Igboho’s release would attract wild jubilation.

“Chief Sunday Igboho will be out very soon and there will be massive jubilation across the entire Yorubaland.

“He is no doubt a courageous man. This is very authoritative just that our Yoruba leaders should stop being selfish and allow good to prevail,” the lawyer said.

This comes after members of Agbekoya Worldwide asked the government of Benin Republic to free Igboho or they would use traditional means to get him out.

IPOB alleges plot to kill Nnamdi Kanu’s lawyers

The Indigenous People of Biafra (IPOB) has warned of alleged plans by the Federal Government to kill the lawyers of Nnamdi Kanu.

This allegation was contained in a statement issued on Friday by the IPOB spokesman, Emma Powerful, in Awka, Anambra State.

He gave the names of the lawyers as Ifeanyi Ejiofor and Aloy Ejimakor.

The statement reads, “We wish to put the whole world on notice about the wicked plot by the frustrated government of Nigeria to secretly eliminate our resilient lawyers, Ifeanyi Ejiofor and Aloy Ejimakor, over their committed efforts in the defence of our leader.

“The Nigerian government is not happy with the expertise and professional prowess of these veteran lawyers and other members of the legal team to deflate the fabricated charges against our leader, hence, their plot to eliminate them.

Intelligence report at our disposal also indicates that this covert plan extends to the elimination of Mazi Benjamin Madubugwu, Bright Ishinwa, Chidiebere Onwudiwe and David Nwawuisi.

“Several state coordinators are also on their elimination list, handed down by the Nigerian government to its security agencies.

“The Nigerian government intends to carry out this targeted elimination through the security personnel deployed in South-East under the guise of Operation Golden Dawn to do the dirty job.

“The compromised security agents have decided to eliminate Nnamdi Kanu’s lawyers once they step into any part of the South-East.

“The world should hold Nigeria Government responsible should anything happen to our lawyers and any of those listed above.”

Nigerian govt deceived Kenya over Kanu’s extradition —Lawyer

Aloy Ejimakor, one of the special counsels to incarcerated leader of the Indigenous People of Biafra (IPOB) Nnamdi Kanu, has accused the Nigerian government of deceiving the government of Kenya to extradite the fugitive to Nigeria instead of the United Kingdom.

In a statement on his Facebook page on Sunday, Ejimakor explained that technically, Kanu is still in Kenya as he had traveled to the East African country on a British passport and as such, should have been extradited to the UK and not Nigeria.

“Kanu is technically still in Kenya. Yes, that’s right: In the purest interpretations of foreign relations law, as applied to Britain and Kenya, Mazi Nnamdi Kanu is technically speaking, still in Kenya. How?

“Dual national or not, Kanu departed Britain and travelled to Kenya as a British citizen and Kenya admitted him as such. That’s the starting point.

“So, after his admission to Kenya, it happens that Kanu must be expelled from Kenyan soil (with or without due process), the next natural and legal thing to do is for Kenya to expel him to Britain, not Nigeria.

“Choosing to expel him to Nigeria means that he could’ve also been expelled to any other country than Nigeria.

Why? Because Kanu presented himself to Kenya as a British citizen, not a Nigerian citizen or even a dual citizen.

“In international law, it was clearly a three-way immigration contract between Kanu, Britain and Kenya.

“Nigeria was not a party to it; and Nigeria was never in reckoning at the Kenyan port of entry when Kanu presented himself for admission. Lawyers call it the privity of contract.

Counting from the time of Kanu’s abduction to the infamous rendition, Kenya sighted no other travel document that could’ve, in addition to Britain, attributed another nationality to Kanu, including that of Nigeria. Or, was Kanu admitted to Kenya on a Nigerian birth certificate?

“So, it’s dubious that Kenya attributed Nigerian citizenship to Kanu because sponsors of the abduction and rendition presumably told Kenya that Kanu was born in Nigeria.

“What about the credible claims (in public domain) that Kanu had renounced his Nigerian citizenship? If place of birth should count, then renunciation should count for more.

Kanu is 53 years old. Out of this, he has spent some 30 years in Britain and 23 years in Nigeria. His wife and children are domiciled in Britain and they are British citizens, either by birth or naturalization. Kanu has his home in Britain and pays his taxes there.

“Therefore, as a strict matter of foreign relations law, as applied to Britain and Kenya (minus Nigeria), Kanu is technically still in Kenya. How? Because Kenya was the last country in which Kanu – a bonafide British citizen was lawfully admitted.

“In view of the foregoing, the next best steps for Britain to take, especially in the face of Nigeria’s intransigence, is to ask Kenya to account for the whereabouts of her citizen, Nnamdi Kanu, last seen in Kenya as of June 19th, 2021, as her Majesty’s subject and a free citizen of Britain, not a criminal suspect.”

Nnamdi Kanu never jumped bail —Lawyer, Ejiofor

The legal counsel to leader of the Indigenous People of Biafra (IPOB) Nnamdi Kanu, Ifeanyi Ejiofor has claimed that his client did not jump bail as being presented before the court by the Nigerian government.

According to him, Kanu had to save his life by fleeing the country, after his home was invaded by armed forces.

He spoke during an interview on Arise TV on Monday.

His argument is that his client’s home was invaded in September, ahead of his court appearance on October 14, adding, that he was forced to flee since only the living can face trial
