Labour Party Reacts As PDP Asks Court To Disqualify Tinubu, Peter Obi’s Running Mates

The Labour Party has said that it is responding to a suit filed by the main opposition Peoples Democratic Party (PDP) before the Federal High Court, Abuja, seeking disqualification of the party’s presidential candidate, Peter Obi and his counterpart in the ruling All Progressives Congress (APC), Bola Tinubu.

The Labour Party’s lawyer, Alex Ejesieme, said this while confirming receipt of the suit process.

The PDP filed a lawsuit before the Federal High Court, Abuja against Nigeria’s electoral body, the Independent National Electoral Commission (INEC) to disqualify Obi and Tinubu from participating in the 2023 general elections, along with their new running mates, Senator Datti Baba-Ahmed and Senator Kashim Shettima respectively.

According to the suit with file number FHC/ABJ/CS/1016/2022, the PDP prayed the court to issue an order restraining the INEC from replacing the running mates of Obi and Tinubu.

The opposition party insisted that the respondents can only participate in the election with Doyin Okupe and Kabiru Masari, whom the Labour Party and APC respectively first presented to the commission.

The PDP listed INEC, APC, Tinubu, Masari, Labour Party, Obi and Okupe as the first to seventh respondents in the case.

The main opposition party asked the court to determine if, by the combined interpretation of Section 142(1) of the constitution, Section 29(1), 31 and 33 of the Electoral Act 2022, and INEC’s timetable, the Labour Party and APC’s presidential candidates are bound by the submission of Okupe and Masari, respectively as their running mates.

The party further asked the court to determine if “by the combined interpretation of Section 142(1) of the Constitution of the Federal Republic of Nigeria, Sections 29(1), 31, 33 of the Electoral Act 2022, the first defendant (the Independent National Electoral Commission – INEC) can validly accept any change or substitution of the 4th (Masari) and 7th (Okupe) defendants as running mates of the 3rd (APC) and 6th (Labour Party) defendants.”

I’m Leaving Behind Legacy Of Fighting Corruption In Nigeria, Buhari Says Amid Widespread Graft, Lawlessness

President Muhammadu Buhari says he is leaving behind a legacy of fighting corruption in the country, stressing the need to fight graft for the benefit of present and future generations.

Buhari disclosed this on Thursday while speaking as the special guest of honour as Nigeria marked the 6th African Union Day of Anti-Corruption with a national dialogue on this year’s theme: “Strategies and Mechanisms for the Transparent Management of COVID-19 funds”.

He highlighted the fights that Nigeria has fought against corruption since 2015 and lauded the country’s anti-corruption laws and agencies.

The Nigerian President also urged African leaders to intensify the fight against corruption and create more disincentives for the stealing of public funds.

“Distinguished participants and fellow African leaders, corruption is evil and all efforts at tackling it are desirable. I have monitored the fight against corruption in Africa and I can see both successes and drawbacks.

“The battle must continue for the sake of the continent and its people no matter the difficulties.

“In Nigeria, the fight against corruption has been vigorous since 2015. A lot has been achieved in the areas of arrest, prosecution, conviction, asset recovery and anti-corruption laws.

“I must admit that the fight has not been a bed of roses. Truly, a lot of more work in many fronts is required.

“For example, civil and public servants must be ethical and professional at all times. The private sector must contribute in curbing corruption. The international community needs to close safe havens.

“The judiciary requires more impetus. Perhaps, an International Anti-corruption Criminal Court is needed,” a statement by Garba Shehu, the presidential spokesman quoted Buhari as saying.

Despite having gained power on the back of the promise to fight corruption, which is largely responsible for Nigeria’s rarely improving development crises, Buhari’s government has failed to combat the ills in the public service.

In 2021, a London-based news magazine, The Economist, described the Nigerian President as inept and high-handed, adding that he had also failed to tackle corruption.

The 178-year-old magazine said due to Buhari’s mismanagement of the economy, food prices had soared while life had become more difficult for Nigerians.

The editorial had read in part, “Economic troubles are compounded by a government that is inept and heavy-handed. Mr Buhari, who was elected in 2015, turned an oil shock into a recession by propping up the naira and barring many imports in the hope this would spur domestic production.

“Instead he sent annual food inflation soaring above 20 per cent. He has failed to curb corruption, which breeds resentment. Many Nigerians are furious that they see so little benefit from the country’s billions of petrodollars, much of which their rulers have squandered or stolen.”

The Economist stated that even before COVID-19 in 2020, Nigeria was already witnessing unprecedented poverty.

The United States also described the scale of corruption in Nigeria under Buhari’s administration as “massive” and “widespread”

According to the 2020 Country Reports on Human Rights Practices released by the US Department of State titled ‘Corruption and Lack of Transparency in Government’, the US said, “Although the law provides criminal penalties for conviction of official corruption, the government did not consistently implement the law, and government employees frequently engaged in corrupt practices with impunity.

“Massive, widespread, and pervasive corruption affected all levels of government, including the judiciary and security services.

“The constitution provides immunity from civil and criminal prosecution for the president, vice president, governors, and deputy governors while in office. There were numerous allegations of government corruption during the year.”

Brigade of Guards Tightens Security in Abuja Over Terror Fears

In anticipation of potential terror attacks in Nigeria’s capital Abuja, Nigeria’s Brigade of Guards, responsible for the security of the president, his family and the Federal Capital Territory(FCT), has stationed troops at the captital’s entry and exit points.

To this end, soldiers have intensified stop and search operations with increased checkpoints in view of the development.

Meanwhile, President Muhammadu Buhari, Thursday, said the armed forces response to insecurity in the country was commendable and therefore, pledged the readiness of his administration to provide additional logistics and support to the military towards eliminating terrorism and insurgency in the country.

However, in Abuja, civil servants and other residents had a tough time getting to their offices as the security checks snarled traffic, keeping motorists stranded in traffic for hours.

The traffic gridlock was noticed in Nyanya-Karu Road, Lugbe-Abuja City Gate axis and Gwagwalada-Zuba area.

The tightened security, THISDAY gathered, might not be unconnected to a security alert issued last week by the FCT command of the Nigerian Security and Civil Defence Corps (NSCDC), that the insurgents were planning to attack schools, churches and public infrastructure in the territory.

The situation has forced schools and churches to review their security arrangements.

“We spent more than two hours in the traffic before getting to work,” a resident said.

The new security measures came as the Defence Headquarters (DHQ) said naval troops on anti-bunkering operations in the Niger Delta region destroyed 109 illegal refining sites and arrested 24 oil bunkerers in the last two weeks.

Speaking at a media briefing in Abuja, the Director, Defence Media Operations (DDMO), Maj Gen Bernard Onyeuko, said soldiers recovered over N2.7 billion stolen crude comprising over four million litres of crude oil, two million litres of Automotive Gas Oil (AGO)and 30,000 litres of DPK.

He said troops of Operation Delta Safe, also discovered and destroyed 34 wooden boats, 150 storage tanks, 119 ovens, 104 dugout pits, 27 pumping machines, one weapon, one speed boat, 13 vehicles and seven outboard engines.

Onyeuko said the soldiers achieved the feat while on operation Octopus Grip conducted in creeks, towns and communities in Delta, Bayelsa and Rivers States.

The DMO spokesman, while giving an update on military operations conducted between June 30 to July 14, also said 3,858 Boko Haram fighters and their families surrendered to troops fighting the counter-insurgency war.

Those who surrendered included 505 males, 1,042 females and 2,311 children, as well as six commanders of the terrorists, amongst them, Mallam Mala Hassan, Ali Madagali, Musa Bashir, Buba Dahiru, Jafar Hamma and Abbali Nakib Polisawa.

Within the period under review, Onyeuko said soldiers killed several terrorists and arrested some logistics suppliers/collaborators with various items at various logistics towns within the theatre.

Buhari: Armed Forces Response to Insecurity Commendable, Pledges More Support

President Muhammadu Buhari, who pledged the readiness of his administration to provide additional logistics and support to the military towards eliminating terrorism and insurgency in the country, has also described the armed forces response to insecurity as commendable.

He further disclosed that the nation, in the last 12 years, had experienced more security challenges but was quick to hail the operational capability of Nigerian military.

Speaking Thursday at the graduation ceremony of 247 students of the Senior Course 44 of the Armed Forces Command and Staff College, Jaji, the president promised that his government would continue to provide the needed support required to wipe out terrorists and insurgents off the face of the earth.

According to him, “This government will continue to provide the required guidance and support to ensure that the desired results are achieved. The Armed Forces of Nigeria are working tirelessly to enhance their combat effectiveness, operational capability and training necessary to eliminate the threats, in synergy with other institutions and nations.

“The response of the Armed Forces of Nigeria to the Boko Haram insurgency, banditry, militancy, kidnapping as well as the activities of separatists and armed militias amongst others have been commendable.

“We have witnessed recent terrorist attacks in Nigeria bearing the hallmark of national and trans-border insurgents trying to cause havoc in Nigeria as well as in neighbouring countries.

“It will be part of your duty to confront these terrorists and insurgents and wipe them off the face of the earth and bring peace to our countries,” the president told the graduating students.

He described the specifics of their training, which focused primarily on countering security threats as very important, adding that, “combating these prevalent security threats effectively demands that African countries continue to work together at all levels; be it tactical, operational and strategic.”

Appraising the ongoing collaboration of the Armed Forces of Nigeria, Cameroon, Niger Republic, Benin Republic and Chad in a multinational operation to combat the Boko Haram Insurgency in the Lake Chad region, the president said it has been productive, commendable and successful.

“The synergy achieved in operating together must have been enhanced by an understanding of the doctrines of the cooperating forces. This occasion provides me another opportunity to briefly reflect on the state of the Nigerian nation, particularly, regarding national security. The last 12 years have been very challenging for our nation, considering the different security threats that have besieged the country.

“Our government is poised to promote national security and development, as well as to remain committed to promoting a vision of a secure, safe, just, peaceful, prosperous and strong Nigeria. We shall be employing all elements of our national power in ensuring security, a just society, peaceful coexistence, national unity and sustainable development while promoting our good standing internationally.”

President Buhari expressed delight that amongst the graduating students were international officers from sister African countries, saying he was confident they enjoyed the friendliness of the country during their stay.

Rashford, Martial score in United’s win at Melbourne

Anthony Martial and Marcus Rashford got on the scoresheet as Manchester United rallied from a goal down to beat Melbourne Victory 4-1 Friday and hand manager Erik ten Hag his second win since taking over.

It followed their 4-0 thumping of Liverpool in Bangkok on Tuesday when Jadon Sancho, Fred, Martial and Facundo Pellistri were on target.

A well-organised Victory were no walkover and shocked the English giants in front of 74,000 fans at the Melbourne Cricket Ground with a goal on the break in the fifth minute.

United clawed back with goals on the cusp of half-time from Scott McTominay and Martial before Rashford made it 3-1 with 12 minutes left and a Victory own goal capped the deserved win.

“It was good that we were able to recover,” said ten Hag. “It’s pre-season and we wanted to see how the team reacts.

“We went 1-0 behind but we stayed composed and finally just before half-time we scored twice.

“Their defence was really compact and it was difficult to create chances,” he added. “But a couple of times we got behind the defensive line and it was justified that we scored.”

United used 22 players against Liverpool and while Ten Hag largely stuck with the same starting line-up he switched it up at the break with 10 changes.

Captain and centre-back Harry Maguire started for the first time under the Dutchman after missing the Liverpool clash, slotting in alongside Victor Lindelof with Raphael Varane absent from the matchday squad.

David de Gea was also missing after picking up what appeared to be a muscle strain in Bangkok. With Dean Henderson on loan, it was left to back-up keeper Tom Heaton to play the full 90 minutes.

In the absence of Cristiano Ronaldo, Martial again led the line flanked by Jadon Sancho and Antony Elanga.

But they were stunned by a quick counter-attack when Victory broke from their own penalty area with a pass down the right flank behind Luke Shaw finding Ben Folami.

With United wide open in defence, Folami squared the ball to Chris Ikonomidis who calmly tucked the ball past Heaton.

United slowed the pace and began to find rhythm with McTominay going close and Bruno Fernandes only denied by a great save from Melbourne keeper Paul Izzo.

Stroke of luck

They kept pressing but it took a stroke of luck to level the scores in the 43rd minute with McTominay’s shot taking a massive deflection.

A rattled Victory conceded another two minutes later with the lively Martial having a simple tap in after Elanga flicked on Diego Dalot’s cross.

Ten Hag shuffled his pack for the second half with Heaton the only survivor and Rashford taking the captain’s armband.

Fleet-footed Zidane Iqbal looked sharp and dangerous as United starved Victory of the ball and their fresher legs caused problems.

But the chances were few until Rashford stepped up in the 78th minute with a lovely finish after a penetrating ball through from Eric Bailly before the own goal sealed Victory’s misery.

Local fans did have something to cheer about when former Manchester United star Nani made his debut with three minutes left after being signed by the Australian side this week.

United also face Crystal Palace and Aston Villa in Australia before their Premier League campaign begins on August 7.

Court extends order stopping demolition of Kpokpogri’s house

A High Court of the Federal Capital Territory in Maitama, Abuja on Friday, extended the order restraining the Minister of the Federal Capital Territory, Muhammad Bello, from further demolishing the residence of Abuja socialite, Prince Joseph Kpokpogri.

The order followed an ex-parte application that Kpokpogri who is a former lover of popular Nollywood actress, Tonto Dikeh, filed through his team of lawyers led by Chief Mike Ozekhome (SAN).

Justice Charles Agbaza held that the order would subsist until the hearing and determination of the suit the Claimant brought before the court.

“This court has the powers to grant an extension of the order in exercise of its discretion so as to preserve the Res (subject matter) of this suit.

“It will serve the interest of justice to allow the order to remain alive until the determination of the matter. Accordingly, this matter is hereby adjourned till September 12,” Justice Agbaza held.

The FCT Minister had through his lawyer, Y. Abubakar, urged the court to vacate the restraining order which he said ought to elapse after seven days.

“It is exactly eight days after the order was made. The Rule of this court provides that such order shall abate after seven days and there is no formal application for its extension,” Abubakar submitted.

However, counsel for the Claimant, Richard Ebie, urged the court to revalidate the order which he argued had no definite lifespan until the determination of the case.

“There is no formal application before this court for the ex-parte order made on July 7 to be vacated.

“This is a case where a party had, on its own, decided to take laws into its own hands. If the order is set aside that means they will have a leeway to continue the demolition,” Ebie added.

After he had listened to both sides, Justice Agbaza dismissed the oral application by counsel to the FCT Minister.

Ozekhome had at the last adjourned date, told the court that some persons from the Federal Capital Development Authority, had on May 14, invaded his client’s residence, “accompanied by a multitude of heavily armed policemen and bulldozers and excavators”, and commenced the demolition of his house, beginning with the boys quarters.

He told the court that agents of the FCDA threatened to return for total demolition of Kpokpogri’s house, even though they failed to give any reason for their action.

Consequently, Ozekhome begged the court to intervene in the matter, in the interest of justice.

Aside from the FCT Minister, other Defendants in the suit are the Federal Capital Territory Administration and the Federal Capital Development Authority, Abuja Metropolitan Management Council, Federal Housing Authority, and the Attorney General of the Federation.

Specifically, the court issued an order of interim injunction restraining the Defendants either by themselves, agents, officials, privies, all those purporting to have derived title from them or other persons howsoever called from trespassing on or further trespassing on, demolishing, or further demolishing the property known as Plots 203 and 204, 27 Road, Gusape District, Apo Estate, Abuja, covered by letters of allocation issued by the Federal Housing Authority with Ref. No. FHA/BD/ES/APO/P.203 and Ref. No. FHA/BD/ES/APO/P.204 or from evicting the occupants of the said property or in any way interfering with the plaintiff’s exclusive right of possession of the said property pending the determination of the motion on notice.

Kpokpogri is among other things, praying the court to order the Defendants to pay him aggravated and general damages to the tune of N2 billion.

In an affidavit he personally deposed to, the Claimant told the court that he is the beneficial owner and the person in exclusive possession of all that property known as Plots 203 and 204, 27 Road, Apo Estate, Abuja, covered by letters of allocation issued by Federal Housing Authority with Ref. No. FHA/BD/ES/APO/P.203 and Ref. No. FHA/BD/ES/APO/P.204 respectfully.

Court orders immediate review of judges, others’ salaries

A National Industrial Court, Abuja on Friday ordered the Federal Government to put machinery in place for the immediate review of the salaries and allowances of the judicial officers in Nigeria.

Justice Osatohanmwen Obaseki-Osaghae who issued the order held that the current salaries and allowances of judicial officers in the country are not only abysmally low but embarrassing.

Justice Obaseki-Osaghae gave the order while delivering judgment in a suit filed against the Federal Government by Chief Sebastine Hon (SAN).

He ordered the Federal Government to commence a monthly payment of N10 million to the Chief Justice of Nigeria, N9 million to other Justices of the Supreme Court, N9 million to President of Court of Appeal.

Also, other Justices of the Appellate Court would get N8 million; Chief Judges of both Federal and States High Courts (N8 million), while Judges of the Federal and States High Courts would receive N7 million.

The Judge held that the refusal of the government to review the judicial officers’ salaries and allowances for 14 years was unconstitutional, unlawful and should be compelled to do the needful.

Justice Obaseki-Osaghae lamented that it was unfortunate that justices and judges who are ministers in the temple of justice have become victims of injustice in the country.

American missionary sentenced to 10 years imprisonment for sexual assault of 14-year-old Ugandan girl.

An American missionary, Eric Tuininga, was sentenced to 10 years in a US Federal Prison after he was found guilty of defiling a 14-year-old Ugandan girl, who was under his care at the Orthodox Presbyterian church based in Mbale District.

Mr Tuininga, 45, of Milledgeville Georgia was ordered to pay $20,000(about Shs75m) in restitution by US District Judge Marc. T. Treadwell and spend a lifetime on supervised release as a registered sex offender after getting out of prison.

In February, Mr Tuininga pleaded guilty and was taken to jail pending sentencing. He faced up to 30 years in jail, according to reports at the time.

Several US media outlets reported that the recommended sentence for Mr Tuininga was seven to nine years.

However, the judge gave him a 10-year sentence after hearing testimony from the victim’s caretaker and some of Tuininga’s family members. Tuininga’s lawyer had requested a sentence of five years.

“I want to recognize the true bravery displayed by the Ugandan girl for speaking out when she was assaulted by a trusted person of power from another country, courageously seeking justice across continents,” US Attorney Peter D. Leary is quoted in a statement.

“Law enforcement, both abroad and here at home, took on a challenging international case,” he added.

In 2019, Mr Tuininga was reported by a fellow US citizen working at the same church who contacted the US Embassy in Kampala that the now convict was having sex with Ugandan girls as young as 14 years who were under the care of their church.

The US Department of State, Bureau of Diplomatic Security federal agents in Kampala opened an investigation into the allegations and subsequently identified the abused minor, who was then aged 14, in May 2019 when Tuininga had sex with her.

Tuininga had already returned to his home in Georgia but the Department of Homeland Security, Homeland Security Investigations, Child Exploitation Unit, Atlanta, continued with the investigations.

“Eric Tuininga used his trusted position as a pastor to sexually assault a young Ugandan girl in his care, this was a challenging case, but law enforcement worked diligently to ensure that Tuininga did not escape justice for his crime overseas,” said US Attorney Peter D. Lear.

Mark Bube, general secretary of the denomination’s committee of foreign missions, has said Tuininga’s misconduct was reported by other Orthodox Presbyterian missionaries in Uganda and that he was removed from missionary work in 2019.

Bube said Tuininga was later removed entirely from ministry and excommunicated from the church based in Willow Grove, Pennsylvania.

Tuininga joined the church from a separate but affiliated denomination in Oregon. A website chronicling Tuininga’s work in Uganda said he began working there in 2012 after working at Immanuel’s Reformed Church in Salem.

Three children killed after Colombia landslide buried school.

Three children were killed Thursday, July 14, by a landslide that buried a rural school in the municipality of Andes in northwestern Colombia, authorities said.

The landslide hit a group of preschool and first-grade children who were taking recess along with a teacher and the mother of one of the students.

“We give very sad news: three children lost their lives in this event,” the mayor of Andes, Carlos Osorio, told the media.

An earlier report had said eight children were trapped.

“Fortunately, 17 students got out alive … the teacher and the mother also,” Osorio said, adding that two other children were already in a stable condition in a nearby hospital.

Dozens of villagers helped rescuers from the military in the effort to save the children.

Video footage shared on social media showed dozens of people with shovels trying to remove a heap of felled trees and rubble. Two digging machines were also deployed.

Eliana Rincones, the school’s only teacher, told journalists there were 22 children present at the time of the landslide.

“We were at recess when suddenly we heard something very loud; we all turned (to look) and in a matter of seconds we all ran,” she said.

“We didn’t even know where we were running.”

The landslide was the result of heavy rains plaguing much of Colombia.

Buffalo shooting suspect indicted on federal hate crime charges

A federal grand jury has returned a 27-count indictment charging Payton Gendron, 19, of Conklin, New York, with 14 violations of the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act (Shepard-Byrd Act) and 13 firearms offenses in connection with the mass shooting at the Tops grocery store on Jefferson Avenue in Buffalo, New York.

The announcement was made by Attorney General Merrick B. Garland, Assistant Attorney General Kristen Clarke for the Justice Department’s Civil Rights Division, U.S. Attorney Trini E. Ross for the Western District of New York, and Special Agent-in-Charge Stephen Belongia of the FBI Buffalo Field Office.

According to the U.S. Department of Justice, the indictment alleges that on May 14, Gendron opened fire with a Bushmaster XM rifle and shot multiple individuals in and around the Tops grocery store, which resulted in the deaths of 10 Black people, as well as injury to three others.

The indictment charges that Gendron violated the Shepard-Byrd Act by willfully causing the death of the victims because of their actual and perceived race and color.

In total, the 27-count indictment charges Gendron with 10 counts of hate crimes resulting in death, three counts of hate crimes involving an attempt to kill three injured individuals, and one hate crimes count alleging that Gendron attempted to kill additional Black people in and around the Tops grocery store.

The indictment also charges Gendron with 13 counts of using, carrying, or discharging a firearm in relation to the hate crimes, and seeks forfeiture of items, including the weapon used in the shooting.

The indictment further includes special findings alleging, among other things, that Gendron committed the offense after substantial planning and premeditation to commit an act of terrorism.

“Today, a grand jury has indicted Payton Gendron with hate crime and firearms offenses following the horrific attack on the Black community of Buffalo that killed 10 people and injured three others on May 14, 2022,” said Attorney General Garland. “The Justice Department fully recognizes the threat that white supremacist violence poses to the safety of the American people and American democracy. We will continue to be relentless in our efforts to combat hate crimes, to support the communities terrorized by them, and to hold accountable those who perpetrate them.”

Gendron, who described himself as a fascist, a white supremacist and an antisemite, reportedly possessed a 180-page manifesto that revealed troubling perceptions he had. He complained of the dwindling size of the white population and included his fears of ethnic and cultural replacement of white people.

His live-streamed shooting spree has left at least 10 dead and several more wounded. Unlike the multitude of unarmed Black people killed during encounters with law enforcement, the white racist is alive to plead not guilty in court.

“While past violent white supremacist attacks seem to have factored into this heinous act, we must acknowledge that extremist rhetoric espoused by some media and political leaders on the right promoting theories that vilify or dehumanize segments of our society like ‘the great replacement theory’ is a factor too,” wrote U.S. House Homeland Security Chairman Bennie Thompson in an earlier statement.

Council on American-Islamic Relations (CAIR) National Deputy Director Edward Ahmed Mitchell added that the organization condemns both the white supremacist terrorist attack targeting Black men and women in Buffalo and the racist rhetoric that has sparked such violence.

“The constant repetition of white supremacist conspiracy theories on social media and even mainstream media outlets has led to horrific violence in places as distant as Christchurch, El Paso, Oslo and Charleston,” Mitchell said. “Those who promote racism, white supremacy, antisemitism, Islamophobia, and other forms of bigotry must be held accountable for the violence they inspire.”

If convicted, the charges in the indictment carry a maximum penalty of life imprisonment or the death penalty.

Gendron is currently in state custody pending state criminal charges.
