Court sentences IGP to three months in prison for contempt

Justice Mobolaji Olajuwon of the Federal High Court, Abuja has sentenced the Inspector-General of Police (IGP), Usman Baba to three months in prison for disobeying a court order, Vanguard reports.

Olajuwon issued the ruling on Tuesday, November 28, 2022, following a suit filed by Patrick Okoli, a former police officer who claims he was unlawfully and compulsorily retired from the Nigerian police force.

According to the affidavits in support of the suit, the applicant was forcefully retired in June 1992.

After challenging his forceful retirement, a Bauchi high court on February 19, 1994, delivered judgment in favour of the applicant and quashed the letter of compulsory retirement.

The high court also ordered that the applicant be reinstated with all rights and privileges. The Police Service Commission (PSC) in a letter dated October 13, 2004, directed the then-IGP to reinstate the applicant and issue a recommendation for promotion in accordance with the decision of the court.

Consequently, Okoli instituted a suit marked FHC/ABJ/CS/637/2009 at the Abuja federal high court seeking an order of mandamus to compel the enforcement of the order of the Bauchi state high court and the directives of the PSC.

The applicant took further steps to enforce the order including approaching the federal house of representatives who then wrote to the office of the IGP.

After efforts failed, the applicant approached the law firm of Festus Keyamo, to commence a committal proceeding against the respondent.

Delivering judgment, Olajuwon held that the IGP should be committed to prison and detained for a period of three months, or until he obeys the order.

“It is unfortunate that the chief enforcer of the law is one who has deliberately refused to comply with the same law. It is important to state that obedience to orders of court is fundamental to the good order, peace and stability of a nation,” the judge held.

“It is a duty which every citizen, who believes in peace and stability of the Nigerian state, owes the nation and the court has a duty to commit the individual who has failed to carry out the order of the court for contempt, so as to prevent the authority and administration of law from being brought to disrespect and to protect the dignity of the court.

“The terms of the Orders of this Court are clear and unambiguous. This court Is satisfied that the respondent (presently and those before him) has had proper knowledge of the Orders of this Court, there is no denial of such knowledge and the receipt of Forms 48 and 49.

“The respondent filed a counter affidavit, was duly represented in court by different counsel, who stated how they had written several legal opinions which were not attended to.

“The refusal and failure of the respondent to comply with the orders of this court has been proved in this case.

The respondent, in this case, the inspector-general of police, in the person of Usman Alkali Baba, is to be committed to prison and detained in custody for a period of three months or until he has obeyed the order of this court, made on the 21st October, 2011, in all things that are to be performed, whichever period is shorter.

Police arrest five suspected armed robbers including 17-year-old girl in Enugu

Operatives of the Enugu State Police Command have arrested five suspected members of a robbery gang including a 17-year-old girl.

Spokesperson of the command, DSP Daniel Ndukwe, who disclosed this in a statement on Tuesday, November 29, said the suspects blocked the road at the Garki axis of Enugu/Port-Harcourt Expressway and robbed travelers.

According to the PPRO, the teenage girl, Jennifer Nwafor was arrested for harbouring one of the male suspects.

“On 05/11/2022 at about 4 am, a combined team of Police Operatives drawn from Awkunanaw Police Division, Operation Restore Peace and Safer Highway Patrol, with assistance from Neigbourhood Watch Group, arrested one Kasie Ani (male) aged 25, Tochukwu Igwe (male) aged 25, Felix Maduakonam (male) aged 24, Chidera Okoye (male) aged 21 and Jennifer Nwafor (female) aged 17,” the statement read.

“Their arrest is sequel to the Team’s swift response to a distress call alleging that the suspects blocked the road at the Garriki axis of Enugu/Port-Harcourt Expressway and were robbing travelers.

“The four (4) male suspects were consequently arrested and the victims rescued, while the female suspect was arrested thereafter, for harbouring one of the male suspects.

Exhibits recovered from the suspects includes: three (3) mock guns that they used in the criminal operation, twenty one (21) pieces of wrappers, clothes, phones, ATM cards and other valuables belonging to their victims.

The suspects will be arraigned once investigations are concluded, he added.

Meanwhile, the Commissioner of Police, CP Ahmed Ammani, has urged the personnel to remain focused on the fight to flush unrepentant criminal elements out of the State, while soliciting the continued support and cooperation of citizens of the State.

Kano bans tricycle operations on major roads

The Kano Road Traffic Agency has banned tricycle riders known as “Adaidaita Sahu” from operating on some major roads in Kano.

The ban will come into effect from Wednesday, November 30, 2022.

The order was contained in a statement by the Public Relations Officer of KAROTA, Nabilusi Na’isa, and issued to newsmen in Kano on Tuesday, Nov. 29.

The statement partly reads: “Adaidaita Sahu drivers (tricycle operators) are prohibited from following Ahmadu Bello Way by Mundubawa road to Gazawa and Tal’udu road to Gwarzo.” As an alternative, the government has provided 100 ultra-modern buses and 50 taxis that would be conveying passengers on the prohibited roads.

The statement adds that the government will also announce when tricycle operators will stop using other major roads in the state once it provides more ultra-modern buses and taxis to serve as alternatives.

Fire breaks out at Ondo broadcast station

The Ondo State Radiovision Corporation (OSRC) in Akure, Ondo state capital, has been gutted by fire.

The fire incident which occurred on Sunday, November 27, affected some offices on the first floor of the broadcasting station.

Ondo State Fire Service responded to the distress call and stopped the fire from spreading to the studio in the complex which houses three stations of the media group and also the headquarters of the state government-owned broadcast media, the OSRC.

Chairman of the station, Adekunle Adebayo, who revealed that the fire incident occurred at the administrative section of the building, further disclosed that there was no human casualty and that operational facilities including transmitters and studio equipment at the OSRC TV, Orange FM and Alalaye FM are intact.

The statement read;

“Following a comprehensive review which certified that the transmission operations of the stations of the Ondo State Radiovision Corporation can recommence after the unfortunate fire incident of the early hours of today Sunday, November 27, the Management of Ondo State Radiovision Corporation has directed a gradual resumption of transmission for the three services.

“In this regard, the Sunshine 96.5FM Alalaye will resume at exactly 12pm today. This is to be followed in sequence by Orange 94.5FM and the Television services respectively.”

Governor Adeleke sacks monarchs appointed by Oyetola

Governor Ademola Adeleke has directed security agents to take over the palaces of Owa of Igbajo, Aree of Iree and Akinrun of Ikirun, who were appointed to the position by his immediate predecessor, Oyetola Gboyega.

The New Osun state Governor who had earlier reversed all appointments made by Oyetola in all Osun ministries, departments, agencies, commissions, boards and parastatals after July 17, suspended the monarchs in one of the executive orders he signed on Monday, November 28.

Spokesperson for Osun governor, Olawale Rasheed, who released a statement on the contents of the six orders signed by Adeleke, said all appointments of traditional rulers made by the immediate past administration after July 17, 2022, would be reviewed.

The statement read; “The Executive Governor of Osun State, Senator Ademola Adeleke, has issued six executive orders to take immediate effect.

“The orders signed this morning by His Excellency covered chieftaincy matters, appointment issues, setting up of review panel, staff audit and employment matters.

“Each of the executive orders are reproduced below:

1. Executive order on state bank accounts“I, hereby, order the immediate freezing of all government accounts in all banks and other financial institutions.

2. Executive order number two on staff audit“All Heads of Ministries, Departments, Agencies, Commissions, Boards and Parastatals of Osun State Government are hereby directed to carry out an immediate staff audit of the actual number of government workers in their various Ministries, Departments, Agencies, Commissions, Boards and Parastatals, as of July 17, 2022, and should file a report to the Office of the Chief of Staff to the Governor stating the full details and position/designation of each of the staff on the forwarded list within seven working days from the date of this Executive order using the attached Oath of Fidelity Template.

3. Executive Order number 3 on Employment“All employments in the service of Osun State Government made in any capacity into any capacity in all the Ministries, Departments, Agencies, Commissions , Boards and Parastatals after July 17th, 2022 be and are hereby nullified.

4. Executive order four on appointments

“All appointments in the service of Osun State Government made in any capacity into any capacity in all the Ministries, Departments, Agencies, Commissions, Boards and Parastatals after 17th July, 2022 be and are hereby reversed.

5. Executive order number five on chieftaincy affairs and appointment of traditional rulers.

“All appointments of traditional rulers made by Osun State Government after 17th July, 2022, are hereby ordered to be reviewed to ensure there was strict compliance with due process of chieftaincy declarations and native law, custom and tradition relating to such chieftaincies.

In the case of Ikirun, Iree and Igbajo, to avoid further breakdown of law and order, the appointments of Akinrun of Ikinrun, Aree of Ire and Owa of Igbajo are hereby put on hold pending review. Subsequently, the palaces of Akinrun of Ikirun, Aree of Iree and Owa of Igbajo should remain unoccupied, while security agencies are hereby ordered to take charge.

6. Executive order number six setting up review committees.

FG issues travel advice to Nigerians traveling to the US and UK after both countries authorities issued terror threats about Nigeria

The Federal Government has advised Nigerians traveling to the United States, the United Kingdom, and some European countries to be wary of thieves targeting their personal belongings.

Minister of Information, Lai Mohammed, gave the advice on Monday, Nov. 28, in Abuja while speaking at the Fifth edition of the PMB Administration scorecard, 2015-2023.

He said there are multiple reports of theft of valuables, including passports of Nigerians so it became imperative to warn Nigerians.

He said:

“It has come to the attention of the government that Nigerian travelers to the United States and some countries in Europe are having their belongings, especially money and international passports, stolen at an increasingly high rate.

“The most recent victims of this are travelers to the UK, most of whom were dispossessed of their belongings at high brow shops, particularly in the high street of Oxford.

“We have therefore decided to advise Nigerians traveling to Europe and the United States to take extra precaution to avoid being dispossessed of their belongings.

“This is not your typical travel advisory. Issuing such is the prerogative of our embassies/high commissions as well as the Ministry of Foreign Affairs. It is merely a piece of advice to Nigerians who may be visiting the affected parts of the world.”

The advice comes one month after the US and UK authorities issued a travel advisory to citizens over a likely terror threat in Abuja, Nigeria.

Four Injured As Car Hits Okada On Lagos-Ibadan Expressway

Four persons have sustained varying degrees of injuries after a car hit them at Forthright Junction along the Lagos-Ibadan Expressway on Monday.

Eyewitnesses claim that the car, which was speeding swerved into the turning and in the process hit the victims.

Our correspondent observed that while two of the male victims fell on sides of the vehicle, the female victim ended up on the boot.

The other person in the car was also injured. The victims have been moved to a hospital in Arepo by the driver and other passers-by.

FG borrows N24tn from CBN amid fiscal risks

The Federal Government has borrowed N6.31tn from the Central Bank of Nigeria through Ways and Means Advances in 10 months.

This has pushed the Federal Government’s borrowing from the CBN from N17.46tn in December 2021 to N23.77tn in October 2022.

The N23.77tn owed the apex bank by the Federal Government is not part of the country’s total public debt stock, which stood at N42.84tn as of June 2022, according to the Debt Management Office.

The public debt stock only includes the debts of the Federal Government of Nigeria, the 36 state governments, and the Federal Capital Territory.

Ways and Means Advances is a loan facility through which the CBN finances the shortfalls in the government’s budget.

According to Section 38 of the CBN Act, 2007, the apex bank may grant temporary advances to the Federal Government with regard to temporary deficiency of budget revenue at such rate of interest as the bank may determine.

The Act read in part;

“The total amount of such advances outstanding shall not at any time exceed five per cent of the previous year’s actual revenue of the Federal Government.

All advances shall be repaid as soon as possible and shall, in any event, be repayable by the end of the Federal Government financial year in which they are granted and if such advances remain unpaid at the end of the year, the power of the bank to grant such further advances in any subsequent year shall not be exercisable, unless the outstanding advances have been repaid.”

However, the CBN has said on its website that the Federal Government’s borrowing from it through the Ways and Means Advances could have adverse effects on the bank’s monetary policy to the detriment of domestic prices and exchange rates.

“The direct consequence of central banks’ financing of deficits are distortions or surges in the monetary base leading to adverse effects on domestic prices and exchange rates i.e macroeconomic instability because of excess liquidity that has been injected into the economy,” it said.

The World Bank had, in November last year, warned the Nigerian government against financing deficits by borrowing from the CBN through the Ways and Means Advances, saying this put fiscal pressures on the country’s expenditures.

Despite warnings from experts and organisations, the Federal Government has kept borrowing from the CBN to fund budget deficits.

The PUNCH had reported that the Federal Government paid an interest of N2.03tn from January 2020 to November 2021 on the loans it got from the CBN through the Ways and Means Advances.

It was also reported that the Federal Government paid an interest of N405.93bn from January 2022 to April 2022 on the loans it got from the CBN.

The Managing Director/Chief Executive Officer of Cowry Asset Management Limited, Mr Johnson Chukwu, recently said the central bank’s lending to the government was putting pressure on the exchange rate and the inflation rate, with “liquidity that has no productivity attached to it coming into the system.”

A development economist, Dr Aliyu Ilias, criticised the government for its constant reliance on borrowing, which was unhealthy for the economy.

He further urged the government to seek better ways of generating revenue rather than persistently borrowing from the apex bank.

Presidency advices Nigerians to leave the country if migrating legally is good for them

The presidency has insisted that the recent increase in migration from Nigeria is not peculiar to the country alone or a new development.

Appearing on a Channels Television program on Sunday, November 27, presidential aide Femi Adesina stated that the average Nigerian have always wanted to leave and people should not equate it to something being wrong.

Adesina said;

“The average Nigerian had always wanted to leave. And it is not just in Nigeria. It is in most countries of the world, particularly in the third world.

“They always believe that it is greener on the other side.

“You see, the truth is that if you have an opportunity to better yourself in any part of the world, there is nothing wrong with it. If you think migrating legally is good for you, all well and good. By all means, go!

“But you cannot now say that because people are leaving, then it is a sign that something is fundamentally wrong.

“There are Nigerians who would never leave the country no matter how things are”.

Adesina also spoke about the country’s security, adding that President Muhammadu Buhari’s administration would hand over a safer country.

He added;

“No doubt about it. He would leave a safer country. When he came in 2015, you could not be sure Nigeria would exist in the next one month. As of 2015, what was happening was that nobody could confidently say that Nigeria would be on the map in the following next week, month or year. But we saw that he came and took the battle to the insurgency.

“When he came, the insurgency was the main thing and he took the battle to them. Then, it became hydra-headed – banditry, kidnapping for ransom, cultism, and separatist agitations joined. How many challenges can one administration really confront? That’s the issue with the Buhari administration. From day one till now, it was from one challenge to the other.”

A good Samaritan, Ben Kingsley Nwashala, who rescued a 2-year-old girl abandoned by the roadside in Agbani area of Enugu state in June this year, has shared a heartwarming photo of him and the child.

Back in June, Nwashala disclosed that the child was delivered by a mentally unstable woman who normally stays at a market in Agbani.

In a post shared on his Twitter handle, Nwashala posted new photos of him and the baby girl.

Police PRO, Olumuyiwa Adejobi reacts to post on extortion from Festac

The spokesperson of the Nigeria Police Force, CSP Olumuyiwa Adejobi, has said that the police force receives more cases of extortion carried out by officers from its FESTAC town division than any area in Lagos state.

He stated this while reacting to a Twitter user who recounted how police officers extorted his younger brother on November 22.

Reacting to the tweets, Adejobi called on the state police PRO and the state Commissioner of Police to flush out the erring officers in the area.

Man caught with 101 PVCs sentenced to one year in prison

The Independent National Electoral Commission has announced that a Sokoto resident, Nasiru Idris, who was arrested for being in possession of 101 permanent voter cards (PVCs), has been sentenced to one year in prison.

INEC’s spokesperson, Festus Okoye said Idris was apprehended on October 10 following an intelligence report.

The statement read;

“In the last couple of weeks, the police have arrested some individuals found to be in illegal possession of voter cards in some states.

“In one case, the police concluded the investigation and handed over the case file to the commission resulting in the successful prosecution of one Nasiru Idris at a Magistrate Court in Sokoto who was found to be in possession 101 PVCs in contravention of Sections 117 and 145 of the Electoral Act 2002. He has been sentenced to a year in prison.

“Similarly, the police in Kano state have arrested a man who was found to be in possession of 367 PVCs. The suspect has been charged to court and the commission is pursuing his prosecution.”

Inspector General of Police orders distribution of weapons for 2023 elections

The Inspector-General of Police, Usman Baba, has ordered the distribution of weapons for officers across the country in preparation for the 2023 general election.

He also ordered all Commissioners of Police in the country to activate the Inter-Agency Consultative Committee on Election Security to engage stakeholders in evolving strategies for mitigating threats to the elections.

The IG noted that political violence, hate speech, threats, political intolerance and misinformation were all potential threats to national security interests.

In a statement on Sunday, the Force spokesperson, Olumuyiwa Adejobi, said the IG charged the CPs to ensure adequate and strategic deployment of officers and assets to ensure the safety and security of INEC personnel and materials before, during and after the 2023 general elections.

Adejobi said, “Similarly, the IGP has ordered a fresh distribution of gadgets, anti-riot gears, and personal protective equipment for police officers across the federation in preparation for the 2023 general election security management duty.

“The items include non-lethal weapons such as electro-shocks, rubber bullets, water cannons, tear gas, riot guns etc., for crowd control and to minimise casualty risk in eventual confrontations with subversive elements.

“The IG reaffirmed the commitment of his administration to the protection of our democratic heritage and national security interests, while he called on other security agencies and stakeholders who constitute ICCES, as well as members of the public to deliberately aid the NPF in its drive to ensure the safety and security of all and sundry before, during, and after the 2023 general elections.”

Oyo community panics as robbers dispatch threat letter

Landlords and residents in Ifelagba community, in the Ido Local Government Area of Oyo State, have been living in fear after suspected armed robbers notified them of their plan to attack the community.

It was gathered that the armed robbers notified residents in the community of the impending attack through letters that were pasted on the wall of buildings in the community last Saturday.

The robbers, in the letter written in Yoruba language, said they were ready to overpower the vigilantes that had made robbery operations difficult for them in the community.

The letter read in part,

“We are coming to collect our rights and money in your houses. We will use all our power and strength to fight the vigilantes because of all their wicked acts and how they have stopped us all these years. We are armed robbers and we will show you who we are at the end of this month when we invade your community. Be prepared.”

One of the residents, Tayo Oresanya, said the situation had deprived them of sleeping peacefully at night, adding that they still felt unsafe despite the presence of policemen patrolling the community.

Oresanya said,

“We sleep with one eye closed because we don’t know when these people will attack us. For armed robbers to get the boldness to tell us when they want to attack shows that they have really prepared for us. We have security operatives patrolling the community, but we still don’t feel safe, we have left everything in God’s hand.”

A community leader, who refused to mention his name for security reasons, said five out of the six gates leading to the community had been locked to keep residents in the community safe.

He said, “Since we received the letter, the police have been patrolling the area. The letter was pasted in strategic houses. It shows that they are people living with us.

“We cannot disclose all the security measures we are putting in place to ensure we save the lives and property of our people. But I can tell you that we are on top of the matter.”

A security expert, Wale Olatunji, said the police must carry out a discreet investigation to ascertain those living within the community that may be part of the robbery gang.

He said,

“The police must be discreet in their investigation and plan on how they want to secure the community so that they don’t end up giving information to one of the robbers.”

Contacted, the state Police Public Relations Officer, Adewale Osifeso, promised to get back to our correspondent for a reaction.He had yet to do so as of the time this report was filed.
