Court orders FG to account for $460m Chinese loan

Justice Emeka Nwite of a Federal High Court in Abuja, has ordered the Federal government to “account for the spending of $460 million Chinese loan to fund the failed Abuja Closed-Circuit Television (CCTV) project.”

In a ruling delivered last week, the court also ordered the government to “publish the total amount of money paid to Chinese and local companies and contractors and specific details of the names of the companies and contractors and status of the implementation of the project.”

The court gave the order while delivering judgment in a Freedom of Information suit number: FHC/ABJ/CS/1447/2019 brought by Socio-Economic Rights and Accountability Project (SERAP).

The Sun reports that the suit followed the disclosure in 2019 by the Minister of Finance, Zainab Ahmed, that “Nigeria was servicing the loan”, adding that she had ‘no explanations on the status of the project.’

She reportedly said:

“We are servicing the loan. I have no information on the status of the CCTV project.” In his judgment, Justice Nwite agreed with SERAP that “there is a reasonable cause of action against the government.

Accounting for the spending of the $460 million Chinese loan is in the interest of the public. It will be inimical for the court to refuse SERAP’s application for judicial review of the government’s action.”

“The Minister of Finance is in charge of the finance of the country and cannot, by any stretch of imagination, be oblivious of the amount of money paid to the contractors for the Abuja CCTV contract and the money meant for the construction of the headquarters of the Code of Conduct Bureau (CCB).”

Justice Nwite also ordered the government “to provide the details clarifying whether the sum of N1.5 billion paid for the failed contract meant to construct the headquarters of the Code of Conduct Bureau (CCB) was part of another loan obtained from China.”

“SERAP’s core objectives are to promote human rights, transparency and accountability and anti-corruption in Nigeria. I am of the humble view that there is a reasonable cause of action against the government [through the Minister of Finance] and I hold that SERAP has made out a case to be entitled to the reliefs sought. The law is well settled that where a document or letter is sent by post, it is the law that the same is taken or presumed to have been delivered.

Following this principle of law and relying on exhibit OS2, SERAP’s Freedom of Information request sent to Ms Ahmed is deemed to have been delivered.

Therefore, the averment by the government [through her] that they were not served with the letter is, hereby, discountenance. I hold.”part of the judgment read

Inmates crown Seun Kuti ‘General Overseer’ as he leads prayer sessions

Embattled Afrobeat singer and son of Afrobeat legend, Fela Anikulapo-Kuti, Seun Kuti, who is currently being remanded at the State Criminal, Investigations and Intelligence Department, SCIID, Panti, Yaba, Lagos on the orders of Yaba Chief Magistrate Court for assaulting a police officer, has been crowned the ‘General Overseer’ of his cell by the inmates.

Vanguard reports that a copy of the Holy Bible was said to have been handed over to him as an instrument of his office.

His appointment as the GO was however not without some drama after the inmates initially rejected him.

In a video that went viral, Seun was seen slapping a police officer on the Third Mainland bridge on May 13, which prompted an order for his arrest by the Inspector-General of Police, Alkali Baba.

Seun however submitted himself to the police accompanied by his lawyers on Monday May 15, and was arraigned at a Sabo, Yaba Chief Magistrate Court on Tuesday which ordered his remand.

According to the report, after Seun was taken to the cell to join other suspected criminals, his first shocker was the hoarse, deep baritone voice of the leader of the inmates who directed him to keep standing.

A few minutes later, a crisis erupted inside the cell as the inmates were said to have rejected him.

The inmates were banging on their metal protective door, asking that Seun should be taken out of the cell.

The report quotes sources as saying that as the uproar by the inmates escalated, Seun started negotiating for peace to reign.

That was when he noticed that the commotion his presence caused and his rejection by the inmates attracted little or no attention from the police guards.

At that stage, he reportedly promised to dole out N25,000 to them and he was directed to produce it without delay.

He had to beg for a phone to call his wife who quickly brought the money which was handed over to their leader.

The inmates subsequently accepted him (Seun) and provided a space for him to sit down.

Seun was reportedly infuriated by the ugly development that played out that he refused to eat the food provided for him including the food brought by his wife.

The hunger strike continued for almost a day and a half until he finally started eating.

The climax of the drama was that the inmates later crowned him the General Overseer of the cell and a bible was handed over to him.

That means that he is presently leading the inmates in prayer sessions whenever the need arises after which they would all chorus: GO, GO.

According to the report, Seun was seen clutching the Bible tightly with his left hand while climbing the stairs leading to the office of the Deputy Commissioner of Police in charge, Waheed Ayilara, on Friday afternoon.

He was later led down the stairs and back into the cell.

Sources said those who have visited the embattled singer are his elder brother, Femi, and other family members as well as his lawyers and some friends.

NAFDAC seals tomato paste warehouse, arrests suspect

On Thursday, the National Agency for Food, Drug Administration and Control (NAFDAC) sealed a facility of imported contraband tomato paste distribution warehouse in Rivers.

Adeniran Kazeem, the NAFDAC assistant chief regulatory officer, Apapa Lagos, made this known to journalists in Port Harcourt.

Mr Kazeem said this after the arrest of Mr Obiora John, the Managing Director of Integrated Wholesales Services Limited in Trans-Amadi Layout, who allegedly imported and distributed contraband tomato paste, which is in the federal government list of contraband importation products in the country.

Mr Kazeem also said Obiora John allegedly removed the seal placed on his facility by the agency in November 2022.

“Upon our interrogation, we noticed that the company removed the agency seal placed at the facility in November 2022 without the agency’s approval,” Mr Kazeem explained.

“The company’s accountant told us that the company had stopped the importation and distribution of contraband tomato paste since 2020, but we found out that the imported tomato paste seen at the facility was manufactured in 2022.”

He added,

“We also found out from the company’s records that there have been importation and distribution of the products to date.”

The NAFDAC official said the agency’s aim of raiding and sealing contraband drinks and food distribution companies in the country was to promote, encourage and create an enabling environment for local manufacturers.

He advised the public to stop patronising the distributors of imported contraband products in the stores and open the market, revealing that the suspect had been arrested.

Obiora John, the managing director of Integrated Wholesales Services Limited at Trans-Amadi industrial layout, said the company was operating a sketchy business to hold their clients till the company starts production at the newly built production factory.

Mr John said he removed the seal because he thought that he could remove the seal after payment to the agency.
